Free Appropriate Public Education (FAPE) in Texas

In Texas, the concept of Free Appropriate Public Education (FAPE) is defined under federal and state law, specifically the Individuals with Disabilities Education Act (IDEA) and corresponding state regulations. FAPE guarantees that all students with disabilities receive individualized education and related services at no cost to the family, designed to meet their unique needs and prepare them for further education, employment, and independent living.


Access to Education: FAPE ensures that students with disabilities have access to public education, including special education and related services, at no cost to the parents. These services are provided in accordance with an Individualized Education Program (IEP) that is tailored to the student's specific needs.


Appropriate Education: The education provided must be tailored to the individual needs of the student, enabling them to receive educational benefits. This includes the provision of specially designed instruction and accommodations to meet the child's unique needs.


Placement Options: Texas law requires that students with disabilities be educated in the least restrictive environment (LRE) that is appropriate for them. This means that, to the maximum extent appropriate, students should be educated with their non-disabled peers.

  • Homebound or Hospital Services: For students who are unable to attend school due to medical conditions, education can be provided at home or in a hospital.


Individualized Assessment and Services: Each student must receive a comprehensive evaluation to determine eligibility for special education services. An IEP team, including the parents, teachers, and other specialists, develops an IEP that outlines the student's current levels of performance, specific educational goals, and the services needed to achieve those goals.


Parental Rights: Parents have the right to participate in all meetings concerning their child’s identification, evaluation, and educational placement. They also have the right to dispute resolutions if they disagree with the school's decisions regarding their child's education.
