ARD Disciplinary Procedures: Manifestation Determination

  • Purpose: The aim is to determine if the behavior leading to a disciplinary infraction is connected to the child’s disability.


  • Process:

    • When Required: A manifestation determination review is conducted whenever there is a decision to change the placement of a child with a disability due to a violation of student conduct codes.

    • Scope of Requirement: This review is necessary for removals that represent a change in placement.

    • Exemptions: It is not required for removals of less than 10 consecutive school days that do not amount to a change in placement.

  • Time Frame: The review must occur within 10 school days of any decision to change the placement of the child.


  • People Involved:

    • Local Education Agency (LEA): Participates in the review process.

    • Parent: Actively involved in the review.

    • Relevant Members of the Child’s IEP Team: Included as determined by both the parent and the LEA.
